1. Acceptance of Terms

By accessing or using Lumber Locater's website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Lumber Locater provides an online platform that connects:

  • Buyers — contractors, builders, makers, and individuals seeking to purchase lumber, building materials, and related products
  • Sellers — lumber yards, building material suppliers, and other vendors listing inventory and products on our platform

Lumber Locater serves as an intermediary facilitating connections and communications between Buyers and Sellers. We do not buy, sell, or take possession of any products listed on our platform.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. For Buyers

4.1 Quote Requests

When you submit a quote request through our platform:

  • You authorize Lumber Locater to share your request details with relevant Sellers
  • Sellers are independent third parties; transactions are solely between you and the Seller
  • Lumber Locater does not guarantee responses, pricing, or product availability
  • You are responsible for verifying product quality, specifications, and legality

4.2 Transactions

All purchases and transactions occur directly between Buyers and Sellers. Lumber Locater:

  • Is not a party to any transaction between Buyers and Sellers
  • Does not warrant the quality, safety, or legality of products sold
  • Does not guarantee delivery, accuracy of descriptions, or condition of goods
  • Is not responsible for any disputes between Buyers and Sellers

5. For Sellers (Lumber Yards & Suppliers)

5.1 Listing Requirements

By listing products on Lumber Locater, you represent and warrant that:

  • You are authorized to sell the listed products
  • Product descriptions, pricing, and availability are accurate and current
  • You comply with all applicable laws, regulations, and industry standards
  • You have proper business licenses and insurance

5.2 Fees

Seller fees are described on our List Your Yard page and any applicable service agreements. Fees are non-refundable unless otherwise stated.

6. Pro Membership

Pro Membership benefits include volume pricing, priority quote responses, and other features. Membership is subject to:

  • Monthly or annual subscription fees as displayed at time of purchase
  • 14-day free trial with no charge until trial expires
  • 30-day money-back guarantee for unsatisfied members
  • Automatic renewal unless cancelled before renewal date
  • Termination for violation of these Terms

7. Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose
  • Submit false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Interfere with the proper operation of the platform
  • Attempt to gain unauthorized access to any accounts or systems
  • Collect user information without consent
  • Use automated tools to scrape or extract data

8. Intellectual Property

The Services and all content, features, and functionality are owned by Lumber Locater and are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, reproduce, distribute, or create derivative works without permission
  • Use our trademarks without prior written consent
  • Remove or alter any proprietary notices

9. Third-Party Links & Content

Our platform may contain links to third-party websites or services that are not owned or controlled by Lumber Locater. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • Information on the platform is accurate or complete
  • Any errors in the Services will be corrected
  • Products listed by Sellers meet your requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMBER LOCATER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from transactions between Buyers and Sellers
  • Damages from third-party conduct, errors, or service interruptions

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lumber Locater and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including attorney fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any transaction between you and another user

13. Privacy

14. Termination
